Who can serve as inspector of elections for a Sacramento County HOA?

For Sacramento County associations, the inspector of elections must meet the independence requirements outlined in California Civil Code § 5110(b). The law focuses on status, not professional credentials. What matters is that the inspector is truly neutral. To qualify, an inspector must be an independent third party, someone who:

  • Has no role in the association’s leadership
  • Is not running for the board
  • Has no family relationship with any candidate or director
  • Is not providing any other paid service to the association

The statute allows a wide range of qualified individuals, including people with experience in regulated or impartial roles, such as county poll workers, licensed accountants, or notaries public. These examples illustrate the type of independence required, but the list is not limited to those professions.

Can our Sacramento HOA vote electronically?

Most Sacramento County HOAs can vote electronically, but only if the association’s election rules already authorize electronic voting. This requirement comes from AB 2159, which took effect on January 1, 2025. Election rules also cannot be amended within 90 days of an election, so associations must have electronic voting language in place well before their timeline begins. Two statutory limits matter for Sacramento associations:

  • Civil Code § 5105(i): regular and special assessment votes cannot be conducted electronically under any circumstances.
  • Civil Code § 5105(i)(1)(C)(i): a paper ballot must still be mailed to any member who opts out of electronic voting or does not have an email address on file.

Electronic voting can streamline participation, but Sacramento County HOAs must follow these strict statutory requirements to remain compliant.
