Election by Acclamation
When the number of qualified candidates is no greater than the number of open seats, Civil Code § 5103 lets the board seat them without mailing ballots at all. It is the cheapest outcome available to a small association and it still has to be done correctly: a regular election within the prior three years, the initial notice, a reminder notice between 7 and 30 days before the nomination deadline listing the qualified candidates so far, and written acknowledgment to every nominee. We run the nomination process so acclamation actually holds up.
Who this is for
Small and self-managed associations that struggle to fill seats, where a contested ballot may never be necessary.
What's included
- Candidate eligibility verified against your governing documents
- Initial nomination notice on the statutory timeline
- Reminder notice 7 to 30 days before the deadline, § 5103(b)(2)
- Written acknowledgment to every nominee, accepted or not
- Ballots mailed only if a contest actually materialises
Where we run this
Election by Acclamation for homeowners associations in San Diego County and Sacramento County. The count happens in public at your meeting under Civil Code § 5120, so we only take on elections where we can be in the room or on the call for it.
