Recall and Removal Elections
A recall is the highest-stakes vote an association runs, and it is the one most likely to end up in front of a judge. Removal of a director is a secret-ballot matter under Civil Code § 5100(a)(1), and members holding 5 percent of the voting power can call the special meeting under Corporations Code § 7510(e). We run it exactly as the statute reads, and we do not take a side.
Who this is for
Boards facing a member-initiated recall petition, and member groups who need the count run by someone with no relationship to the sitting board.
What's included
- Petition signatures verified against the membership roll
- Special meeting noticed on the Corporations Code § 7511 timeline
- Ballots received, logged and held sealed and irrevocable
- Challenges to the right to vote heard and decided on the record
- Public count with your members entitled to witness it
- Written result and full custody of the record for a challenge
Where we run this
Recall and Removal Elections for homeowners associations in San Diego County and Sacramento County. The count happens in public at your meeting under Civil Code § 5120, so we only take on elections where we can be in the room or on the call for it.
